Homicide Charges in Orange County
Types of Homicide and Your Defenses:
Most people think of a homicide as just a murder. But, there are different
levels of homicide and they are listed below:
- First Degree Murder
- Second Degree Murder
- Voluntary Manslaughter
- Involuntary Manslaughter
- Justifiable Homicide
- Excusable Homicide
A person can be responsible for killing another person and be convicted
of first degree murder, or be completely acquitted because the killing
was justified (self-defense) or the killing was an accident (excusable
homicide). If a person does a negligent act that results in the death
of another, such as negligently discharging a firearm, the killing can be
involuntary manslaughter. If the killing is the result of "heat of passion' or "provocation,"
such as during a fight of some kind, the killing can be
voluntary manslaughter rather than murder.
The different kinds of homicide carry wide-ranging sentences. Justified
or excusable homicide result in no conviction at all. Involuntary manslaughter
can result in probation or up to four years in prison. Voluntary manslaughter
can result in probation or up to eleven years in prison. Second degree
murder can result in probation or fifteen years to life in prison. First
degree murder results in twenty-five to life, life without parole or the
death penalty, depending upon what are called "special circumstances."
